Terms and Conditions

1. www.thesuffolkprovidore.co.uk is owned by The Suffolk Providore Ltd.

2. The use of and purchase of goods from this website are governed by these Terms and Conditions. By submitting an order on the website you are agreeing to these Terms and Conditions. They do not affect your statutory rights.

3. We may amend these Terms and Conditions without prior warning. The date of any such amendment will be published at the end of this document. Orders placed after this date will be bound by the changes made.

4. Registration

4.1 To order from us you must be a registered customer.

4.2 In order to register with us you must be 18 years or over and have completed the registration process on the website.

4.3 The registration process is for the collection of customer details only. Payment for any goods ordered will be required before delivery.

4.4 You are responsible for ensuring registration details are correct at all times and for informing us of any changes to these details should they occur.

4.5 Any information you provide us with will be treated with the upmost security. We will use these details to send you information about our services, products and product prices. We will not sell or rent your information to any third party (please see separate privacy and security policy for details).

4.6 Upon registration you will be asked to provide a password for your account. This password is confidential and should not be shared with anyone. You will be responsible for all orders and purchases submitted under this password. You are to notify us immediately if you suspect anybody knows your password. If we have reason to believe that there may be a security breach or misuse of our website we may require you to change your password or we may suspend your account at any time.

5. Purchasing

5.1 You may submit orders by using the website at any time after you have registered. By submitting an order you confirm that you have checked it through, made any necessary amendments and that it is an order for the goods that you require.

5.2 We will confirm acceptance of your order by email, to the address supplied on registration, telephone call, to the number supplied on registration, or by an acceptance message displayed on the website after an order has been submitted. We may do any or all of these confirmations, acceptance of an order will deem to have been confirmed with whichever arrives soonest.

5.3 Once an order has been confirmed as accepted you cannot amend, withdraw or cancel it.

6. Payment

6.1 We will only accept payment by credit or debit card via the website. The cards accepted by us will be listed on the website on the date on which your order is placed. We do not accept cash or cheques.

6.2 Your credit or debit card details will only be retained by our payment service provider Sage Pay (www.sagepay.com, please see separate privacy and security policy for details).

6.3 We will take payment from your card prior to delivery once your order has been selected and packed.

6.4 We reserve the rights to cancel an order, suspend your account and terminate any agreement with you should we be refused authority of payment at any time. You agree to repay us all costs and expenses incurred by us in the event of a failed payment. In the event of such a failed payment an administration charge of £15 will also be charged.

7. Product Availability and Prices

7.1 Where an order is accepted we will do our upmost to ensure that it is fulfilled. Products are however subject to availability, seasonality and market conditions. Many of the producers used by The Suffolk Providore Ltd are small and the quantity of products produced each week may vary greatly. We reserve the right to limit the quantity of goods supplied.

7.2 If we are unable to deliver an item that has been ordered we will notify you immediately and remove this product from the order. You will not be charged for these items. We will, however, bear no liability for unavailability of products.

7.3 If you discover a delivery to contain incorrect goods or to be incomplete in any way you are to notify us by telephone within 2 hours of delivery. We will endeavour to replace incorrect goods and or redeliver any missing goods as soon as is conveniently possible. Our liability will be limited to the price of the goods incorrectly or not delivered, and the cost of delivery.

7.4 All products offered on the website are subject to occasional change in price especially products that are subject to seasonal market conditions. The price you will pay for a product will be the website price at the time of order except in the instance of a technical error on the website for which we will not be liable.

7.5 Some products on the website are priced by weight or volume. In these instances the guide weight/volume and associated guide price shown in the order on the website and the order confirmation are for guidance only. The weight you receive may vary from this and you will be charged for the actual weight/volume of produce delivered. We will endeavour to supply produce as close to the guidance weight/volume and associated price as possible.

7.6 The prices listed on the website are inclusive of any VAT due.

8. Delivery and Delivery Charges

8.1 The Suffolk Providore Ltd only delivers to a specified area. You should check under the ‘Delivery’ menu on the website that we deliver to your postcode before placing an order. We reserve the right to eliminate certain areas from our delivery routes and to refuse to accept orders from any customer due to delivery area restrictions.

8.2 Orders will be delivered to the address specified when the order is placed.

8.3 Once your order has been confirmed we will contact you by e mail and where possible text message to confirm your delivery date and time. You will be given a two hour window on the given date within which the order will be delivered.

8.4 We will make every effort to deliver to you on the confirmed date within the confirmed delivery window. We will reserve the right to change this date and time and will inform you if we do so. We will not be liable if we fail to deliver or are late in delivering, in full or in part, due to circumstances beyond our control such as, but not limited to, vehicle breakdown, traffic conditions or adverse weather. If we fail to deliver at the confirmed time we will contact you as soon as possible, at the contact details given with your order, to reschedule delivery.

8.5 It is your responsibility to make arrangements to receive the delivery ordered. If you will not be present to take delivery of the order you must clearly state the following in the delivery instructions when placing the order;

1. That you are happy for the delivery to be left at the delivery location.

2. Details of exactly where the delivery should be left at the delivery location.

If there is no suitable person present to take delivery of an order, and no details given in the delivery instructions as to the above, we will leave notification of attempted delivery and you will have to contact us to re-arrange delivery for an additional delivery fee. We are not liable for the deterioration of goods due to unsuccessful delivery.

8.6 We are not liable if a delivery is damaged or stolen when left as instructed at a delivery location. We are also not liable for any deterioration of goods left as instructed.

8.7 Delivery will be charged at £3.99 for orders of goods totalling £74.99 or less. Delivery for orders of goods totalling £75 and over will be free of charge.

9. Quality of Goods

9.1 The quality of the goods supplied by The Suffolk Providore Limited is guaranteed. It is your responsibility to inspect the products delivered. If you are unhappy with any of the products delivered you must notify the delivery driver or telephone us within 24 hours of receipt of goods. We will arrange to collect the products, and at your discretion, either replace them or give you a full refund. This refund will take place within 30 days. For non-perishable goods they must be unused and in the original packaging delivered.

10. Offers and Promotions

10.1 Any promotional offers made on the purchase of goods through this website will be subject to the Terms and Conditions of the promotion. We may withdraw promotional offers or change the terms of the promotion at any time without prior notice. At our discretion we reserve the right to offer different customers different promotional offers.

11. Website

11.1 All content of this website is the property of The Suffolk Providore Limited. You may not reproduce, modify, copy, distribute or use for commercial purposes any of the materials or content of the website without our permission.

11.2 We cannot guarantee that the website will be free from faults or interruption. We will endeavour to fix any problems with the website as soon as they become known to us.

11.3 While we will endeavour to verify the accuracy of any information on The Suffolk Providore Limited website we make no warranties, whether express or implied, in relation to its accuracy.

11.4 This website will contain links to other websites and materials beyond our control. We are not responsible for content on any website outside of www.thesuffolkprovidore.co.uk.

12. Rights To Cancel

12.1 We may suspend or cancel your order or registration immediately at our absolute discretion or if you breach any of your obligations under these Terms and Conditions.

13. Liability

13.1 We will not be liable to you or any third party for any consequential or incidental loss.

13.2 We will not be liable for any loss, goodwill or damage related to our website or its use. We disclaim all liabilities in connection with errors or interruption of the website, incompatibility of the website with any equipment or software and inadequacy of our website to meet your requirements.

13.3 Our maximum liability to you resulting from any one order and the subsequent supply of goods will be limited to the retail price of the goods and delivery charge relating to that order.

13.4 Nothing in these Terms and Conditions will exclude our liability for personal injury or death caused by our negligence.

14. General Applicable Terms

14.1 These Terms and Conditions shall be governed and construed in accordance with the laws of England and Wales.

14.2 Any disputes with these Terms and Conditions will be decided only by the English Courts .

14.3 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

14.4 The Suffolk Providore Limited website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties or guarantees of any kind save those set out in these Terms and Conditions.
